UNEARTHING ORIGINAL DISPUTES IN CRIMINAL ADJUDICATION

Modern criminal procedure heavily relies on pre-trial plea bargains, summary dispositions, and standardized charging documents that frequently obscure the underlying, authentic factual conflict between the state, the victim, and the accused. This article examines the systemic mechanisms that sanitize or erase the "original dispute" in criminal adjudication. It analyzes how formal legal narratives substitute contextual social conflicts with legal categories, evaluates the constitutional and retributive costs of resolution mechanisms that bypass factual discovery, and proposes reformative evidentiary and procedural frameworks designed to unearth and address the genuine genesis of criminal controversy.
