Davlat immuniteti tushunchasiga yuzlanar ekanmiz, ushbu tushuncxha to`g`risida nazariy qarashlarni o`rganib chiqish juda muhim hisoblanadi. Davlat immuniteti turli xil shaklda ifodalangan bo`lib, ba`zi holllarda konseptsiya, ba`zi hollarda esa, doktrina yoki prinsip shaklida yuritiladi. Amaliyotda davlat immuniteti odatda protsessual norma sifatida ko`riladi. Bir so`z bilan aytadigan bo`lsak, “Davlat immuniteti milliy sud yurisdiktsiyasiga kiradigan protsessual qoidadir.
