БЕЗОРИЛИК ЖИНОЯТИНИНГ ОЛДИНИ ОЛИШДА УМУМИЙ ПРОФИЛАКТИКАНИНГ ЎРНИ (АҚШ МИСОЛИДА)
Abstract
Безорилик жинояти, яъни умумий қонунчиликда "vagrancy" деб аталувчи ҳолат, жамиятнинг ижтимоий-иқтисодий мураккабликларининг энг кўриниб турувчи кўринишларидан бири ҳисобланади. АҚШда бу жиноят турлари XIX асрдан бошлаб кузатиладиган муаммо бўлиб, у одатда уй-жойсизлик, ишсизлик ва ижтимоий маргиналлашуви билан боғлиқ. Умумий профилактика эса, жиноятчиликнинг олдини олиш назариясида, жамиятнинг умумий аҳолисини ҳуқуқбузарликдан сақлаш учунги қонунчилик, тарбия ва ижтимоий чораларнинг мажбурий тизими сифатида тушунилади. АҚШ мисолида умумий профилактика безориликнинг олдини олишда муҳим ўрин тутади, чунки бу мамлакатда безорилик нафақат жазо тизими орқали, балки ижтимоий сиёсат ва жамоатчилик фаолияти орқали ҳал этилади.
