ANALYSIS OF PUNISHMENT MITIGATING CIRCUMSTANCES CHARACTERIZING A PERSON WHO COMMITTED A CRIME (ON THE EXAMPLE OF THE CRIMINAL LAW OF UZBEKISTAN)

Abstract

In this thesis, the author analyzes the circumstances that facilitate the punishment characterizing the person who committed the crime, which is taken into account when prescribing punishment, within the framework of the criminal law of Uzbekistan. In particular, the importance of a minor person and a pregnant woman as an mitigating condition for committing a crime is highlighted. The recognition of the culprit's state of pregnancy as a punishment mitigating condition is an expression of the state's concern for the protection of the health of the expectant mother and child, while the criminalization of a minor is recognized as a punishment mitigating condition criminal law is a valid expression of the humanitarian principle.
